Supreme Court To Decide On Poker Legality Case Friday

The Top Online Casino Gambling News Reporting Site Since 2002!

Published on February 19, 2014 by Tom Jones

A long battle has been raging and lines have been drawn in the sand regarding the legality of poker, and whether the game is one of luck or skill. That question has been asked in court rooms all across the US, but as of yet the US Supreme Court has not weighed in on the subject.

On Friday, poker enthusiasts and opponents alike will get their answer as to whether the Supreme Court will hear a case that is being appealed in the state of New York. The case involves a bicycle shop owner who was holding a poker game amongst friends in the back of his bike shop.

Authorities arrested the man and charged him with operating an illegal gambling operation. The owner, who has been convicted, is appealing his case to the Supreme Court, asserting that poker should not be illegal because it is a game of skill.

There is precedent across the US on both sides of the issue. Several courts have ruled that poker is a game of skill, while others have ruled there is too much chance in the game for it to be considered a game of skill. Each state has their own laws regarding home poker games.

In Virginia, home games are legal. In Georgia, the same games are illegal. How the federal government sees poker is a key to states that are attempting to move forward and allow home games among friends.

If the Supreme Court decides Friday to take the case, it will serve as a mini-victory for those who want the law clearly defined. A Supreme Court ruling on whether poker is a game of skill or luck could also go a long way in shaping the future of the poker industry in the US.

Nevada, Delaware, and New Jersey have recently taken the game of poker to the next level, regulating online casinos. Over 100,000 poker players have already signed up for accounts at New Jersey online poker sites that host games played for real money.

vizquel17 victorious, earns over $213K in 11/24/13 Sunday Million

^

It was another big Sunday Million this week with 7,107 entrants into the weekly $215 buy-in tournament, the most popular in online poker. That meant a big prize pool of $1,421,400 -- well over the $1 million guarantee -- to be split by the top 1,080 finishers. It would take exactly 12 hours for the tournament to play out, with vizquel17 of Israel ultimately emerging as the winner to claim a big $213,214.40 payday.

Just over five hours after the tourney began, the money bubble burst with Pippa83, ___HotTunà__, and 05Devais07 sitting atop the counts with 1,080 players remaining.

Almost exactly five hours after that the field had been whittled down to 18 players sitting around the last two tables. By then 05Devais07 had been eliminated in 662nd (for $397.99), Pippa83 was out in 278th ($596.98), and ___HotTunà__ had just gone out in 35th ($2,956.51).

Among those also hitting the rail during that stretch were Team PokerStars Pro Liv Boeree (459th, $454.84), Team Online member Mickey "mement_mori" Petersen (605th, $412.50), and Team PokerStars Pros Jake Cody (908th, $312.70) and Vanessa Selbst (928th, $312.70).

Meanwhile it was El major :D in first position with a big stack of almost 11.5 million, with elpipsi87 the nearest challenger with just over 8.2 million.

It would take more than an hour for nine more to fall. 100mile (18th), Armand2011 (17th), and Ullsen187 (16th) each earned $3,979.92 for their finishes. 2rich4u4eva (15th), GASpeer (14th), and JohnDoe00000 (13th) made $5,898.81 apiece. And MyMilkCans=D (12th), QazMiNowPlz (11th), and Teddygram902 (10th) took away $7,871.70 each.

With the tourney about 11 hours and 15 minutes old and elpipsi87 having moved into the top spot with more than 21 million, the final table was underway.

24nov13-sundaymillion-finaltable.jpg

Seat 1: ki92 (Austria) -- 6,646,058
Seat 2: decamps (Norway) -- 3,910,848
Seat 3: jahwise (United Kingdom) -- 4,466,268
Seat 4: elpipsi87 (Belgium) -- 21,021,974
Seat 5: olekasper (Norway) -- 3,234,399
Seat 6: Bluf_To_Much (Moldova) -- 12,396,696
Seat 7: DeLaBijen (Netherlands) -- 5,877,342
Seat 8: vizquel17 (Israel) -- 8,725,798
Seat 9: El mejor :D (Portugal) -- 4,790,617

Not long after the final table got going, the blinds were 250k/500k when El mejor :D open-raised all in for 3,290,617 from the cutoff seat and it folded to decamps in the small blind who called all in for 2,586,449. jahwise was in the big blind and having both players covered called as well, and the three players showed their hands.

decamps: [7c][7s]
jahwise: [9h][9d]
El mejor :D: [Qc][9c]

El mejor :D was the only one without a made hand to start, but after the [5s][Kc][Kh][8c][Jc] board El mejor :D had improved to a winning flush to win the hand and survive. Meanwhile decamps was out in ninth.

The 11-and-a-half-hour break came and went, and almost 10 minutes went by in which no players eliminated. Then came a rapid barrage of knockouts that saw the tournament come to a rapid close within 20 minutes.

The blinds had increased to 300k/600k when the first one of those eliminations took place. After an elpipsi87 open to 1.2 million from under the gun, it folded to El mejor :D on the button who reraise-shoved for 5,917,683. The blinds folded, then elpipsi87 quickly called, turning over [Kd][Kc] to El mejor :D's [Tc][Ts]. The board ran out [As][Ad][9s][Jc][Kh], giving elpipsi87 a full house and ending El mejor :D's tourney in eighth.

Just two hands later it was jahwise shoving for 2,655,888 from the button with [Kc][3h] but getting called by olekasper who woke up in the big blind with [Kd][Ks]. The flop came [Kh][5h][3s], pairing jahwise twice but giving olekasper top set, and after the [Qd] turn and [7h] river they were down to six.

A few minutes after that they'd made it to the next level where the blinds were 400k/800k, which is where DeLaBijen open-raised all in for 7,598,212 from UTG, then ki92 called all in for 6,312,822 from a couple of seats over. The others folded, DeLaBijen showed [6s][6h] and ki92 was hoping to improve to survive with [Ah][Ks].

Alas for ki92, the flop came [5s][Qh][6d] to give DeLaBijen a set of sixes, and the [9h] turn made the [3d] river no matter, knocking ki92 out in sixth.

Just a minute later elpipsi87 was open-shoving for almost 9.6 million from under the gun and vizquel17 called from the big blind. vizquel17 had the edge before the flop with [Ac][Td] versus elpipsi87's [As][7s], and five cards later -- [Ts][3c][2d][2c][2h] -- vizquel17's hand was still best and elpipsi87 was eliminated in fifth.

That hand signaled the start of an avalanche of chips headed vizquel17's way, as the new chip leader would soon be knocking out the last three challengers to claim the Sunday Million title.

First it was vizquel17 min-raising to 1.6 million from the button, then olekasper reraising all in for 4,827,767 from the small blind and vizquel17 calling. olekasper had [6h][6s] and vizquel17 [Tc][7c], and when the community cards came [7d][5d][Jh][9c][5h] vizquel17 had the better two pair and olekasper was done in fourth.

Moments later, DeLaBijen open-pushed for 8,932,070 from under the gun and only vizquel17 called from the small blind. DeLaBijen had [Ah][3h] and vizquel17 [4h][4c]. The board came [Jc][7h][2s], then [8d], then [3d], and DeLaBijen was out in third.

Suddenly heads-up play was starting, with vizquel17 way out in front with 63,789,453 to Bluf_To_Much's 7,280,547. vizquel17 won an initial small hand, then the end swiftly arrived on the second hand between the pair.

The blinds were up to 500k/1m, and after Bluf_To_Much pushed for 6,300,547 from the button with [Jh][9c], vizquel17 snap-called with [As][Js]. The board came [3s][6s][2d][5c][Kh], and just like that vizquel17 had claimed the last of the chips and the win.

WCP VIII: Germany and Japan dominant, Peru closing in (round four over)

^

PCA-2010-thumbnail.jpgJapan and Germany are neck and neck after the first event of Day 2 of the World Cup of Poker with 133 points apiece, Peru just one point behind with 132. Humberto Brenes' Costa Rica team along are yet to break the 100 point barrier and will have to mount the most stunning of comebacks if they are to get their hands on the silverware. Is it even possible? I really couldn't say but once these results have been posted I'll try to find out.

It was a strong round for Peru (34), France (33) and Tajikistan (33), allowing Peru to catch up with league leaders Germany (28) and Japan (29), and France to drag themselves near level with the Netherlands (25). Things are looking pretty bad for both Costa Rica (20) and Team Rest of the World (23).

1. Germany, 133 points
1. Japan, 133 points
3. Peru, 132 points
4. Tajikistan, 125 points
5. Netherlands, 123 points
6. France, 119 points
7. Rest of the World, 97 points
8. Costa Rica, 93 points

Team Japan steps in to take a snap of the evidence

France, who are now back within spitting distance of the top teams, have Philippe Lucas to thank who opted to inexplicably call all-in with [9c][3d]. But this was no random call, no sir, something else was obviously at play. Not being able to speak French the only thing I could understand was the shouts of 'Neuf trois! (that's nine three) and upon further investigation it was then explained to me that '93' is the department number for the area that Lucas is from, a suburb north-east of Paris called Seine-Saint-Denis. Somehow this tactic of calling off your stack based on home location paid off: Lucas went on to win his sit-and-go, beating Masa Kagawa heads up to book full points for France. It's classic World Cup action.

Round five, short-handed sit-and-gos, is under way.

Gambling Law Expert Gives Online Casino Bill Big Odds to Fail

Internet gambling legal authority Toy Cabot told an international conference of gaming insiders that online casino regulatory bills are unlikely to pass through the US Congress.

Most gambling fans would think twice before laying heavy money on a 20-to-1 proposition. Unfortunately, those are the odds of US legislation proposing regulation of online casinos passing, according to a specialist in Internet gaming laws.

Tony Cabot, a Las Vegas lawyer known as an online gambling expert, told the International Masters of Gaming Law conference in Amsterdam that factors influenced by timing make the passage of Barney Frank's bill or any other that introduces licensing of online casinos very unlikely. Despite the fifty-plus cosponsors of the Frank bill, Cabot says political considerations are decreasing the chances of the bill advancing.

Cabot noted that Senate Majority Leader Harry Reid of Nevada has not voiced support for any of the online gambling measures, and says he won't until a clear consensus emerges from the land-based casinos to which Reid caters. Cabot also pointed out that Democrats faced with tough decisions on health care and the economy are wary of giving election opponents any cause on which to rally.

Cabot told the gathering that "...the last thing the Democrats want to get involved in is an unpopular fight because the Republicans would be all over it.”

Even more ominously, Cabot noted that Internet gambling operators who have continued to serve the US market may contribute to defeating any regulatory bill, figuring that their continued presence may prevent them from receiving licensing.

“This is a move that will not come at the federal level,” said Cabot.

Second annual Chad Brown Memorial tournament coming July 2

This time last year, most of Chad Brown's friends knew he wasn't going to be playing in the World Series of Poker. In fact, most people knew he would probably never play poker again. Afflicted with a rare stomach cancer, Brown was in his final days at home, and many people were knocking on his door to say goodbye.

What happened after his death was no less than amazing. Those who hadn't been able to say goodbye in person traveled to Las Vegas for a memorial service, one that, as you might expect, almost immediately turned into a charity poker tournament. Now, the T.J. Martell Foundation for Leukemia, Cancer & AIDS Research has announced it is reprising the tournament to keep Brown's memory alive and serve an important cause in the process.

chad_brown_2nd_tourney.jpg

The event happens Thursday, July 2, 2015 at Planet Hollywood Resort & Casino in Las Vegas. Hosted by Maria Ho, the event kicks off at 6pm with a silent auction and cocktail hour. The tourney itself will start with a 6:00 p.m. cocktail reception and silent auction followed by a 7:00 p.m. tournament. Proceeds from the tournament will help raise funds for important research by the T.J. Martell Foundation's Sarcoma Research Projects. These funds will drive clinical trials and new drug discoveries.

"This annual event will always be a celebration of Chad's life," Maria Ho said. "Chad touched so many so deeply and this is a way to keep his memory alive."

Brown was a legend in the poker community, a longtime Team PokerStars Pro, and a friend to the PokerStars Blog. He was a fixture at the PokerStars Caribbean Adventure, which is why PokerStars has put up a 2016 PCA Main Event seat as part of the prize pool. Other prizes include a 2015 WSOP Main Event seat, a WPT seat and VIP package, HPT seat, mentoring with Zen Poker, a PPC Poker Tour Main Event Seat with travel package, $500 credit with WPT Travel, Poker Academy training with last year's winner Rick Fuller, and more.

Tournament host Planet Hollywood will also promote the "Suck Out Sarcoma" campaign during its Phamous Poker Series Goliath: May 31-July 5, 2015. The "Suck Out Sarcoma" campaign encourages poker tournament players to donate 1% of their winnings to The T.J. Martell Foundation. All funds will go to the Chad Brown Memorial Poker Tournament Fund for Sarcoma Research.

Nice to meet you, Mr Peru

This year's Americas Cup winners' photo won't feature Team Peru. A Mexican clean sweep in the semi-finals, followed by a loss to Colombia in a subsequent play-off, quickly put paid to such ideas. Instead, the Peruvian quintet will take 'just' $2,500 each back to their home country. Will we see them when the next Americas Cup-style tournament rolls into paradise? It's impossible to say. That is, unless of course we're talking about Luis Felipe Villaran Bedoya.

Or as I like to call him, "Mr Peru".

pca2014.acp.humberto luis villaran.jpg

Mr Peru and Mr Costa Rica at this year's Americas Cup of Poker

This weekend Mr Peru represented his country at the poker tables for a third straight year. In 2012 he was part of a World Cup of Poker winning side and personally collected more than $22,500. A year later he added $2,500 after his team finished fourth in a preceding Americas Cup of Poker in Panama.

Yet now, stood in the brightly lit, marble-floored hallway that leads from the Imperial Ballroom back to the Atlantis Resort's thousands of hotel rooms, Mr Peru looks a little deflated about today's $2,500 prize.

"It's a disappointment, but it's poker," he says of Team Peru's fourth place finish. "We carry the hopes of the poker community and it feels very, very good (to represent Peru). I feel a lot of proud."

Dressed in his team's red and white colours, Mr Peru's "proud" is clearly on display here in Atlantis. When he's not living his other life as stock broker in Lima, he plays tournaments on PokerStars on a semi-professional basis, and over the past few years his presence at events like these have turned him into a poker somebody in Peru. It's a fame that is thoroughly deserved.

Thousands of people tried to qualify for this year's Americas Cup. But Mr Peru beat them. Thousands likely tried to qualify for the World Cup of Poker. But, again, Mr Peru beat them. Such consistency in poker isn't common place. So as the Mexican and Chilean teams butt-heads next door in the Americas Cup final, what does he believe the key to consistency is?

"A lot of discipline and hard work," says Villaran. "To qualify for the Americas Cup I played between two and three tournaments for almost 28 days in a row. It was constant. I wasn't trying to win the tournaments but just earn points, points, points. A lot of players don't understand that, they just want to win."

pca2014.acp.002.luis villaran-2-3.jpg

Luis Felipe Villaran Bedoya: once, twice, three times a Peruvian player

Apparently if you want to follow in such successful footsteps and take a shot at Americas Cup glory, you'll need to be "a rock at the beginning" of each qualifying tournament, and make good use of the time clock.

"If the button passes you and you have one blind and one point locked up, I prefer not to push. By the time the blinds comes you could have a lot more points. I like to keep my blinds."

Judging by Villaran's record in such matters and the calm way he delivers each word, it's a strategy I wouldn't argue with. But can such consistency realistically continue?

"Yeah, sure," he says. "This is my third time so I want to come again."

Until next year then I guess, Mr Peru. All the best.

German Internet Casino Ban May Crumble Internally

The first German state to withdraw from the national ban on online casinos will aolmost certainly not be the last.

The German attempt to maintain the state gambling monopoly and bar foreign online casinos may crumble from within. The state of Shleswig-Holstein has promised to open its gaming market to private gambling operators, and withdraw from the agreement among German states to ban online casinos.

The German State Treaty on Gaming united Germany's states insupport of the national Internet gambling monopoly, claiming that doing so is the only viable means of protecting consumers. However, EU findings indicate the move is more financially motivated, protecting the state gaming system from licensed competition by EU online casino operators.

Now, as Schleswig-Holstein becomes the first state to reject the federal reasoning, other states are rumored to be primed to follow suit and allow competitive online gambling in their borders.

Opening the market to EU competition would relieve Germany of potentially costly infringement proceedings by the European Commission. And consumers across Europe are demanding that state protectionist blocks be removed to allow choice in online gambling systems.

Even if some form of the monopoly is presently maintained, the State Treaty ends in 2012, permitting states to license online casinos freely after that point.

NYC Police Observe Need for Regulated Sports Betting

New York's police commissioner noted that illegal sports betting is harmful, proving a need for regulate sports gambling.

Cherry Red Casino! The police commissioner of New York City pointed out this week exactly what gaming advocates have been saying, that illegal sports betting is hurting society. Gambling analysts have reported many times that regulating sports gambling is needed to end the massive sports wagering black market.

“Illegal gambling and money laundering are not victimless crimes," said Raymond W. Kelly at a press conference announcing a major sports betting raid. "The proceeds from illegal sports betting are used to fuel organized crime and support harmful criminal enterprises."

State lawmakers have asserted that sports betting exists even though the federal ban against it continues, only in an illegal and untaxed form. Delaware and New Jersey lead a number of states fighting the NFL and the Department of Justice on the laws making sports gambling illegal.

NFL representatives have claimed only a minute percentage of its fans are gambling, despite figures indicating sports wagering on football alone involves billions of dollars in illegal plays. Legislators wanting to regulate this activity both to create revenue and protect consumers argue that illegal sports betting is doing significant harm.

Kelly spoke at an announcement of the arrest of almost 40 people in a handful of states for taking almost $200 million in action over three years. The need to regulate sports betting and prevent this illegal gaming struck even the commissioner.

Casino Operator MGM Mirage Abandons New Jersey for Macau

Under pressure from regulators, MGM Mirage will sell its share of the Borgata Casino in order to retain its relationship in Macau with Pansy Ho, daughter of gambling magnate Stanley Ho.

Play the Best Slots at Superslots Casino! Forced by regulators to make tough decisions, MGM Mirage officials have decided to sever ties to Atlantic City gambling so as to retain their casino operating structure in Macau. The New Jersey Division of Gaming Enforcement ruled that, in order to keep its license in Atlantic City, MGM would have to end its partnership in Macau with Pansy Ho.

Ho is the daughter of long-time Macau gambling monopolist Stanley Ho. The regulatory board objected to reputed links between the Ho family and organized crime.

Regulators controlling MGM licensing in other states, including Nevada, have allowed the relationship in the Far East to continue, but New Jersey authorities balked, saying MGM could not maintain its share of the Borgata Casino if it persisted in dealing with Pansy Ho. MGM Mirage owns half of the Borgata, while Boyd Gaming owns the other half.

MGM representatives say the company will sell its share of the Borgata over the next two years, choosing the expanding growth of the Macau gambling scene over the struggles of Atlantic City gaming.

MGM Mirage CEO Jim Murren wrote on the company website that he disagreed with the regulators' assessment of Ho, but that 'the best course of action for our company and its shareholders is to settle this matter and move forward with the compelling growth opportunities we have in Macau''.

Previously Australian regulators required James Packer and Crown Casinos to establish a distance between their partner, Lawrence Ho, and his father Stanley, in order to receive approval of the company's Macau gambling ventures.

MicroMillions 6: mark_999 rallies to win Sunday Storm Special Edition and Event #97 $11 NL

It was a revolutionary type of day for mark_999. The Canadian advanced to the final table of MicroMillions 6 Event #97, yet he found himself near the back of the pack. mark_999 waited for the perfect moment to peak at the right time. Along the way, he snapped off pocket Queens with a fortuitous flop, and in another hand, his own pocket Kings held up in a decisive pot. However, mark_999 still found himself as the short stack when he took part in a money chop with three players remaining. Even though he was way behind, mark_999 was not deterred one bit. He somehow got heads-up and woke up with pocket Aces at the perfect time. He avoided an elimination and picked up a timely double up. On the very next hand, mark_999 delivered a stunning knock out blow to successfully complete a come-from-behind victory and win MicroMillions Event #97.

MicroMillions 6 Event #97 $11 NL also doubled as the Sunday Storm Special Edition, which drew in 52,491 runners. They created a prize pool worth $524,910, which was significantly more than the guaranteed prize pool of 300K. The top 6,633 places paid out with $38,110.83 set aside to the eventual champion. That is a juicy dividend on a mere $11 investment.

The Sunday Storm progressed at a rapid pace. Three hours passed before the money bubble popped. Over 90% of the field was liquidated in the first 3.5 hours.

The frantic pace slowed down during the final two tables. Action went hand-for-hand with ten to go, and flaviusff leading the way with over 50 million. Slovakia's KovTa bubbled off the final table in tenth place when A♦J♠ unfortunately lost to mark_999's K♥8♦ after mark_999 flopped two pair. With KovTa's bustout, the final table of nine was set.
